The Cologne Tenants‘ Association processes members’ personal data exclusively for its own purposes of association and membership administration and for the implementation and fulfilment of the association's objectives in accordance with its articles of association. Our employees have access to your data in order to fulfil our contractual and legal obligations towards our members. The employees are obliged to maintain confidentiality and are subject to an appropriate statutory duty of confidentiality, and the Cologne Tenants‘ Association is a member of the North Rhine-Westphalia regional association of the German Tenants’ Association and is affiliated to the umbrella organisation Deutscher Mieterbund e.V. through this membership. It may therefore be necessary to process the data collected beyond the obligations arising from membership in order to safeguard the legitimate interests of the tenants‘ association or third parties.the publication of personal data or images in the media used by the organisation of the German Tenants’ Association, its regional associations and tenants' associations only takes place with the consent of the member concerned, unless the data is generally accessible.
Recipient for data transfer of personal data
Processors engaged by the Cologne Tenants' Association (Art. 28 GDPR) may receive data for defined purposes. These are companies in the areas of IT services, logistics, printing services, telecommunications, debt collection, sales and address research, etc. With regard to the transfer of data to recipients outside the company, please note that we will only pass on your data if this is permitted or required by law, if you have given your consent or if we are authorised to provide information. Under these conditions, recipients of personal data may be, for example: Public bodies and institutions (e.g. public prosecutor's office, police, supervisory authorities) if there is a legal or official obligation.
Storage period of the data
In accordance with the general deletion concept of the Cologne Tenants' Association: We process your personal data for the duration of your membership, which also includes, for example, the initiation and execution of a contract or for the fulfilment of contractual purposes. In addition, we are subject to various statutory retention and documentation obligations, including those arising from the German Commercial Code (HGB) and the German Fiscal Code (AO). The retention and documentation periods specified there are up to ten years. Finally, statutory limitation periods may also be relevant.
Provision of data by the members
As part of membership, members only have to provide the personal data that is required for the establishment, implementation and termination of membership (Art. 6, 1b GDPR) or that the Cologne Tenants' Association is legally obliged to collect (Art. 6, 1c GDPR). Further processing of data may result from legitimate interests, unless the interests or fundamental rights or freedoms of the data subject, which require the protection of personal data, prevail (Art. 6, 1f GDPR).
Information on the right to information and the right to withdraw consent
Every data subject has the right to information, rectification, erasure, restriction of processing and data portability. In addition, the data subject has the right to lodge a complaint with the data protection officer or with a competent data protection supervisory authority. If the processing is based on legitimate interests (Art. 6, 1f GDPR), an objection can be lodged against the processing due to special situations (Art. 21 GDPR).
